TERMS & CONDITIONS OF BUSINESS

Welcome to Laker Kitchens. These Terms and Conditions govern the relationship between the client (“you”& “your”) and Laker Kitchens (“we,” “our,” or “us”). By engaging our services or purchasing products from us, you agree to be bound by the following

1. General Terms

1.1 We are not liable to you for any delay or failure to perform our obligations under the contract if it is due to an event beyond our reasonable control.
1.2 If a court finds any part of these conditions void or unenforceable, that clause or part will be deleted, and the remaining provisions will continue to apply in full.
1.3 If we do not fully exercise one or more of our rights under these conditions, this does not prevent us from exercising any other rights in the future.
1.4 The contract is personal between you & us and cannot be transferred without prior written consent from the company owner, which will not be refused without good reason.
1.5 Unless we notify you otherwise, any notice to be given under the contract should be in writing and addressed to us at the address given.
1.6 These conditions and the contract are governed by English Law and both you and we submit to the exclusive jurisdiction of the Courts of England and Wales.

2. Quotations and Pricing

2.1 All quotations are valid for 28 days from the date issued unless otherwise stated.
2.2 The prices stated in the quotation include VAT, unless explicitly mentioned otherwise.
2.3 We reserve the right to adjust the final price if additional work or materials are required after the initial consultation or as the project progresses.

3 Delivery

3.1 Delivery takes place at the address you have given on the order/invoice order form and will be called works site address.
3.2 We will try to deliver your goods on any agreed delivery date or within a reasonable time.
3.3 We will not be liable to you for any unforeseeable loss, damage or expense you suffer which arises directly or indirectly from any delay in the delivery of the goods which arises from circumstances outside of our control.
3.4 Delivery note must be signed by you, as proof of delivery of the goods.
3.5 If you fail to take delivery of the goods or we cannot deliver them because we have no access to your property, and not given us adequate instruction, permission and alternative of this delivery will result in goods being returned to the manufacturer address, and we will have to pass these costs onto you.
3.6 Any goods returned will incur delivery return cost/storage cost/new re-delivery of goods.
3.7 If you do not take delivery within 18 days from the agreed first or second delivery date given, which you and we agreed on, we may sell these goods at the best possible price to cover our cost and losses.
3.8 We will only be liable for non-delivery of goods if you give us written notice within 7 days of the agreed delivery date, and you giving us a new delivery day, within the same month.

4. Payment Terms

The price of all goods are set out in the quotation, including VAT at its current rate. The price is valid for 28 days from the date of the quotation.
4.1 Your invoice for goods is paid in 2 instalments 50% on day of placing order with us.
4.2 The balance owing of this invoice will be paid by you 7 days before delivery to the address you have given on the invoice/order form.
4.3 Delivery of items will include all cabinets/doors/panels/trims & any cabinet pull-outs, with a second delivery of all appliances and third delivery of any laminate or solid wood worktops.
4.4 For all worktops of glass/quartz/granite/porcelain and all other stonework surfaces & including solid seamless surfaces, and any other stonework surface i.e. marble etc
4.5 This worktop part of invoice is paid 50% on day of template and the balance owing is payable upon satisfactory completion of all worktops & any upstands, windowsills, and wall splashback/wall cladding.
4.6 For all room installations of furniture and including all doors/panels & trims, and with a kitchen, will also include the fitting of all appliances, sink & tap.
4.7 This part of the invoice for room installation is payable 50% payable on first day of fit.
4.8 The total balance owing, to be payable upon satisfactory completion of all fitting/installation.

5. Cancellation and Refunds

5.1 By law you have [14 days Cooling Off Period] as per the Consumer Contracts Regulations 2013 by giving written notice which begins the day after you entered this contract.
5.2 You can waiver these 14 days cooling off, by signing on the contract that you wish for your order to go into production immediately.
5.3 If you cancel the contract within the 14 days, and you have paid a money deposit, we will return any money funds to you in full.
5.4 If you commit a serious breach of the contract which is not remedied within 18 days of receiving notice from us, we may cancel the contract immediately on written notice.
5.5 If we cancel the contract, you will immediately pay any outstanding sums owed to us, along with any reasonable expenses incurred by us in performing all or part of the contract, we may cancel any other contract made by us with you, we have the right on giving reasonable written notice, to enter the premises and remove any goods and materials which belong to us.
5.6 Our rights under these conditions do not prevent us from exercising any other rights to recover amounts due to us for goods delivered to date and any loss, damage, costs, expenses or liability that we have sustained.

6.Installation

6.1 You must ensure that the premises are ready for installation on the agreed delivery date.
6.2 If you have paid for labour to remove your old kitchen or other rooms items in full, you must remove all items in base and wall cabinets, plus items in drawers, so we can remove all cabinets with ease.
6.3 You are responsible for all rubbish and material clearance, being trade we are not able to register to bring rubbish to your local recycling centre, and with some sites not allowing certain items.
6.4 You will need to take your old kitchen and any other rooms contents in your vehicle to your local recycling centre, or yourselves ordering in a skip hire to cover the total time to finish all installation works.
6.5 It is your responsibility for all your old/existing appliances and sink/tap to find good homes, for all your secondhanded appliances, and be refitted, Not by Us.
6.6 If you have no family/friends/neighbours wanting your secondhanded appliances. Please contact your local council, with their pay per appliance pick-ups, where they come and take these away for you, on given day, which you/us will leave them on your property by front gate/driveway for pickup.

7. Materials and Workmanship

7.1 All materials provided will be of a high quality and fit for purpose.
7.2 We guarantee the workmanship of our installation for [12 months] from the completion date. Any defects due to faulty workmanship within this period will be corrected free of charge.
7.3 This guarantee does not cover defects caused by normal wear and tear, misuse, or failure to follow care instructions.
7.4 We do not cover any damage caused by fire, flooding, water leaks, damp/mould, self-damage and damage by break-ins.

8. Customer Responsibilities

8.1 You are responsible for ensuring that all necessary permissions (e.g., planning permissions) are in place before the commencement of work.
8.2 You must provide a safe working environment and ensure that the property is ready for installation
8.3 You must ensure all workman’s tools & property, left on site is safe and secure each day, until the fitting is completed, and your fitter has finished the work, and their tools and any other property have been removed due to the work finished.

9. Liability

9.1 We are not liable for any damage or loss arising from delays caused by factors outside our control, including but not limited to, weather, supplier delays, or third-party contractors, Covid 19 or other far reaching infections.
9.2 Our liability for any claim shall not exceed the value of the products or services provided.

10. Complaints and Dispute Resolution

10.1 If you are unsatisfied with our service, please contact us in writing within 7 days of completion. We will work with you to resolve any issues as quickly as possible.
10.2 In the event of a dispute, both parties agree to attempt mediation before pursuing any legal action.

11. Privacy Policy

11.1 We are committed to protecting your privacy. Any personal information collected will be deleted from computer or paper shredded.
11.2 The only information we keep is your kitchen/bedroom/home office 3D design & floor plan, along with your name, address, e-mail, and phone number along with the order information i.e. paint colour and door name/style etc.
11.3 The above information we keep is to cover your Guarantees on all goods sold, so we have the information of the manufacture we use, to get a replacement free if still under guarantee, or cost of item if you have no guarantee.

12 Returns Policy

12.1 All our cabinets, doors. Panels & trims i.e. cornice, lighting pelmet & plinth are made to size/bespoke size to fit your room space and painted in matt or gloss colour of your choosing.
12.2 We do not accept any returns unless an item is incorrect or has been damaged in transit.
12.3 If an item/items have been damaged in transit, You or Us must take a picture of the item still in it’s packaging, showing the packaging damage lines up with the items damage.
12.4 You or Us must also take a close up picture of the damage to the item/items within 24 hours of the delivery of your goods, so we can email the manufacture with these photos and written e-mail of damaged details, to receive a free quick replacement of item/items, while the fitter/room installer is still on site. 11.5 Items like cabinet pull-outs, under & in cabinet lighting can be returned but at a loss to you.
12.6 Our providers of the above mentioned returnable items, charge us 20% re-stocking fee plus 20% vat charge.
12.7 If you returned any of these above mentioned items, these losses will be pass on to you, at the current rate of a total of 40% charge.

13 Promotions and Sales

13.1 Laker Kitchens will feature [Spend & Save] promotions at various times of the year (Terms & Conditions will apply).
13.2 Spend & Save appliance offer are dependent upon total money spent on kitchens only and including cabinets/doors/panels/trims/cabinet pull-out/worktops.
13.3 The cost of fitting/Installation of your kitchen/room, can not be used in the Spend & Save promotion.
13.4 Qualification for Free Appliances will be dependent on total cost of kitchen items (as stated above) Exclusive of VAT.
13.5 Appliances that we buy for you, weather at retail cost to you, or free in our Spend & Save promotion sale to you.
13.6 We provide all Brand named Appliances.
13.7 The client is responsible for completing the appliance Guarantee/Warranty upon receipt of the appliance/appliances and sending this to the appliance manufacturer.
13.8 In the event of any fault or damage to the appliance, you the client are responsible for reporting this direct to the appliance manufacturer, this is not the responsibility of Laker Kitchens.

These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales. Contact Information
